Is it illegal to sell digital Pokemon on ebay?

I was browsing ebay for old Pokemon games, when I cam across some auctions that have digital Pokemon for sale. Is this illegal or against ebay's TOS?

It does sound like something that could be taken down rather easily on those type of sites, but who knows...
I'm not against it, but I also find it foolish. I wouldn't buy them that way, I'd see it as my own contribution to gaming's shift towards the mobile gaming monetization trends...
